Blue Wave Pool & Spa

SMS / Text Messaging Terms & Conditions

Effective Date: July 15, 2026 | Version 2.0

These SMS/Text Messaging Terms & Conditions (the “SMS Terms”) govern your enrollment in and use of the text messaging program (the “Program”) offered by Blue Wave Pool & Spa (https://bluewavepoolspa.com), operated by Blue Wave Buyer, LLC (“we,” “us,” or “our”). By providing your mobile phone number and opting in, you agree to these SMS Terms and to our Privacy Policy. If you do not agree, do not opt in.

Program Summary — Required Disclosures

1. Program Description

Through the Program, Blue Wave Pool & Spa sends text messages related to your relationship with us, which may include:

• Appointment scheduling, confirmations, and reminders
• Service, installation, and account updates
• Billing, payment, and estimate notifications
• Customer-care responses to your inquiries
• Promotions, offers, and seasonal service reminders, where you have consented to marketing (promotional) messages

2. Consent to Receive Messages

By enrolling — whether by submitting your mobile number through our website form, in person, over the phone, on a service or sales agreement, or by texting our number — you consent to receive recurring conversational, informational, and promotional text messages from Blue Wave Pool & Spa at the mobile number you provided. If you consent to receive one type of message (for example, informational), you agree to receive that type of message from us.

Consent is not a condition of purchasing any goods or services. Your consent applies only to Blue Wave Pool & Spa and is not shared with, or transferred to, any other company for their own messaging or marketing. You represent that you are the account holder or authorized user of the mobile number provided and that the number is accurate. Your opt-in and opt-out requests are logged with the date, time, and method of consent.

3. Message Frequency

Message frequency may vary depending on your interactions with us and the services you have requested.

4. Message and Data Rates

Message and data rates may apply. These charges are billed by and payable to your mobile carrier. Please contact your wireless provider for details about your messaging or data plan. Blue Wave Pool & Spa is not responsible for any charges imposed by your carrier.

5. How to Opt Out (STOP)

You can cancel the Program at any time by replying STOP to any message you receive from us. After you send STOP, we will send you a one-time opt-out confirmation message, after which you will no longer receive text messages from that Program. If you would like to rejoin, simply opt in again as described above.

6. How to Get Help (HELP)

For help or more information at any time, reply HELP to any message, or contact us at support@bluewavepoolspa.com or (203) 248-0429.

7. Carriers and Delivery

Wireless carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your wireless carrier and is not guaranteed. Supported carriers and the Program may change at any time without notice.

8. Privacy

Your information is collected and used in accordance with our Privacy Policy, available at https://bluewavepoolspa.com/privacy. No mobile opt-in or text message consent will be shared with third parties or affiliates. Mobile information — including your mobile number and your opt-in or consent to the Program — will never be sold or shared with any third parties or affiliates for their own marketing or promotional purposes.

9. Changes to These SMS Terms

We may update these SMS Terms from time to time. Changes are effective when the updated SMS Terms are posted at https://bluewavepoolspa.com/sms-terms. Your continued participation in the Program after changes are posted constitutes acceptance of the updated SMS Terms.
